  1. Introduction

Welcome to Shapedeep.

These Terms and Conditions (“Terms”) govern your access to and use of the Shapedeep mobile application, website, learning content, account system, social features, protected content services, and related digital services (together, the “Services”).

Shapedeep is a language learning app designed to make language learning more engaging through lessons, exercises, stories, humor-based learning content, progress systems, streaks, achievements, rewards, social profile features, and related learning tools.

By creating an account, accessing the app, or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree to these Terms, you must not use the Services.

These Terms are intended to explain what you may expect from us, what we may expect from you, and how the Services may be used.

  1. Definitions

For the purposes of these Terms:

“Account” means your registered Shapedeep user account.

“App” means the Shapedeep mobile application.

“Content” means all language learning content, lessons, exercises, images, texts, stories, grammar explanations, audio, user interface elements, designs, logos, software, databases, protected lesson payloads, and other materials made available through the Services.

“Free Services” means Services or features made available without payment.

“Paid Services” means subscriptions, purchases, premium features, ad-free plans, consumable items, or other paid offerings that may be introduced or made available.

“User Content” means content, names, profile details, feedback, reports, messages, or other material that you submit, upload, write, select, or otherwise provide through the Services.

“Virtual Items” means non-monetary app-internal items, balances, rewards, streak tools, XP, JP, CP, achievements, leagues, missions, or similar game-like or learning-progress elements.

“Protected Content” means learning content that is delivered through backend services and is not intended to be extracted, downloaded in bulk, copied, redistributed, scraped, or used outside the normal app experience.

  1. Eligibility

You must be at least thirteen (13) years old to use the Services.

If you are under eighteen (18), you may use the Services only with permission from a parent or legal guardian where required by applicable law.

The Services are not intended for children under 13. If you indicate during onboarding that you are under 13, you may be prevented from continuing.

By using the Services, you represent that:

  1. you are at least 13 years old;
  2. you have the legal capacity to agree to these Terms or have permission from a parent or legal guardian;
  3. you will use the Services only in accordance with these Terms and applicable law;
  4. the information you provide to us is accurate and not misleading.
  1. Account Registration and Authentication

To use core features of the Services, you may need to create an Account.

Depending on the app version and platform, you may register or sign in using:

  1. email and password;
  2. Google Sign-In;
  3. other sign-in providers that may be supported in the future.

You are responsible for keeping your login credentials secure. You must not share your Account with others, sell access to your Account, or allow another person to use your Account in a way that violates these Terms.

You must notify us promptly at support@shapedeep.com if you suspect unauthorized access to your Account.

We may require email verification, password reset verification, recent login, or other security steps before allowing sensitive actions such as account deletion, password reset, profile changes, or access to certain account features.

  1. Onboarding and Learning Preferences

The Services may ask you to provide onboarding information such as:

  1. age category;
  2. source language;
  3. target language;
  4. learning reasons;
  5. how you heard about Shapedeep;
  6. humor preference;
  7. app language;
  8. text-to-speech locale;
  9. notification or sound preferences.

We use these choices to personalize the learning experience, configure the app, determine suitable learning paths, and comply with age-related requirements.

You are responsible for selecting preferences honestly and updating your settings where appropriate.

  1. Description of the Services

Shapedeep may provide features including:

  1. language learning lessons;
  2. vocabulary exercises;
  3. sentence exercises;
  4. grammar-related tasks;
  5. story-based learning content;
  6. humor-based learning experiences;
  7. text-to-speech or pronunciation support;
  8. progress tracking;
  9. XP, JP, CP, achievements, streaks, missions, rewards, and leaderboards;
  10. social profiles, following, followers, and public profile search;
  11. feedback, bug report, and feature request tools;
  12. protected content delivery through backend systems;
  13. analytics and diagnostics if enabled with consent;
  14. future paid features, subscriptions, advertising-supported features, or ad-free features.

Not every feature is available in every app version, country, language pair, platform, test track, or account.

We may add, modify, suspend, or remove features where reasonably necessary for security, legal compliance, platform requirements, service stability, product improvement, or business reasons.

  1. Free Services, Paid Services, and Future Monetization

Shapedeep may offer both Free Services and Paid Services.

At the time of a specific app release, certain Paid Services or advertising features may not yet be active. Where Paid Services are introduced, the relevant price, billing period, renewal rules, cancellation method, included features, and applicable taxes will be shown before purchase.

Paid Services may include, for example:

  1. subscriptions;
  2. premium learning content;
  3. ad-free access;
  4. additional learning tools;
  5. cosmetic profile options;
  6. expanded statistics;
  7. virtual learning tools;
  8. other app features.

Future versions of Shapedeep may include advertising, sponsorships, rewarded ads, non-personalized ads, personalized ads where permitted and consented to, or paid ad-free alternatives.

If advertising or paid features are introduced, the applicable app store disclosures, consent screens, purchase flows, and Privacy Policy information must be followed for the version in which those features are active.

  1. App Store and Third-Party Purchase Terms

If you purchase Paid Services through an app store, such as Google Play or Apple App Store, the purchase may also be governed by the terms, payment rules, refund rules, cancellation process, and technical systems of that app store.

For app store purchases:

  1. billing may be handled by the app store provider;
  2. cancellation may need to be completed through your app store account;
  3. refunds may be subject to app store policies and applicable law;
  4. subscription renewal may be managed by the app store;
  5. we may receive limited purchase status information needed to provide the purchased feature.

If there is a conflict between these Terms and mandatory app store rules for a purchase made through that app store, the mandatory app store rules will apply to that purchase to the extent required.

  1. Subscriptions, Renewals, and Cancellations

If subscriptions are offered, the following rules apply unless the purchase screen states otherwise:

  1. subscriptions may renew automatically at the end of each billing period;
  2. the renewal price and period will be shown before purchase;
  3. you may cancel renewal through the app store or payment provider used for purchase;
  4. cancellation stops future renewal but does not necessarily refund the current billing period unless required by law or the applicable store policy;
  5. access to subscription features may continue until the end of the paid period;
  6. if payment fails, access to Paid Services may be suspended or downgraded;
  7. we may change subscription prices for future billing periods with notice where required.

Free trials may be offered. If a free trial converts into a paid subscription, this will be disclosed before you start the trial. You are responsible for cancelling before the trial ends if you do not want to continue, subject to applicable law and platform rules.

  1. Right of Withdrawal for EU/EEA Consumers

If you are a consumer in the European Union or European Economic Area, you may have a statutory right to withdraw from a distance contract within fourteen (14) days without giving any reason.

The withdrawal period generally begins on the day the contract is concluded for digital services or digital content, unless applicable law provides otherwise.

To exercise your right of withdrawal, you must inform us of your decision to withdraw by a clear statement, for example by email to:

support@shapedeep.com

You may use the model withdrawal form at the end of these Terms, but it is not required.

If you validly withdraw, we will reimburse payments received from you without undue delay and no later than fourteen (14) days from the day on which we receive your withdrawal notice, using the same payment method you used for the original transaction unless another method is agreed.

Early Expiry of the Right of Withdrawal for Digital Content or Digital Services

For digital content or digital services that are made available before the withdrawal period expires, your right of withdrawal may expire early if:

  1. you expressly consent to immediate performance or immediate access before the end of the withdrawal period;
  2. you acknowledge that you may lose your right of withdrawal as a result;
  3. the legal requirements for early expiry are fulfilled.

Where an app store or payment provider handles the purchase, withdrawal and refund processing may also be handled through that provider according to applicable law and platform rules.

Your mandatory consumer rights remain unaffected.

  1. Account Deletion and Termination by You

You may stop using the Services at any time.

Where available, you may delete your Account through the app. You may also contact support@shapedeep.com for account-related assistance.

Account deletion may require recent authentication to protect your Account from unauthorized deletion.

When account deletion is completed, we aim to delete or disconnect your authentication account, private user document, public profile, friend or follow relations, and account-linked learning progress where technically and legally possible.

Some data may remain where retention is required or permitted by law, including payment records, security logs, abuse-prevention records, legal claim records, anonymized or aggregated data, and backups until overwritten.

Deleting the app from your device does not necessarily delete your Account or cancel a subscription. Subscriptions must be cancelled through the app store or payment provider used for purchase.

  1. Suspension or Termination by Shapedeep

We may suspend, restrict, or terminate your access to all or part of the Services if reasonably necessary, including where:

  1. you violate these Terms;
  2. you use the Services unlawfully;
  3. you attempt to scrape, extract, copy, or mass-download Content;
  4. you attempt to bypass protected content systems, rate limits, App Check, authentication, or other security controls;
  5. you manipulate or attempt to manipulate XP, JP, CP, streaks, missions, achievements, leaderboards, rewards, or account state;
  6. you harass, impersonate, threaten, abuse, or mislead other users;
  7. your Account is used for spam, fraud, scraping, security attacks, or automated abuse;
  8. payment for Paid Services fails or is reversed;
  9. we are required to act by law, platform rules, app store requirements, court order, or authority request;
  10. continued access would create security, operational, or legal risk.

Where reasonable and legally possible, we may provide notice and an opportunity to remedy the issue. In serious cases, we may act immediately.

Termination does not affect rights or obligations that by their nature should continue, including payment obligations, intellectual property rights, liability rules, restrictions on misuse, and dispute provisions.

  1. License to Use the Services

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, access, and use the App and Services for your own personal, non-commercial language learning purposes.

This license does not transfer ownership of the App, Content, source code, backend systems, protected content, databases, designs, trademarks, or intellectual property to you.

You may not use the Services except as expressly permitted by these Terms and applicable law.

  1. Intellectual Property Rights

All rights, title, and interest in and to the Services remain owned by Shapedeep or our licensors.

This includes, without limitation:

  1. software code;
  2. app design;
  3. user interface;
  4. logos and branding;
  5. illustrations and images;
  6. stories and learning texts;
  7. grammar and vocabulary structures;
  8. lesson systems;
  9. exercise formats;
  10. protected content;
  11. databases;
  12. generated or curated content collections;
  13. reward systems, missions, streak systems, and achievement structures;
  14. server-side logic and APIs;
  15. documentation and related materials.

You must not remove copyright notices, trademarks, proprietary markings, or technical protection measures.

No rights are granted to you except the limited right to use the Services under these Terms.

  1. Protected Content and Content Security

Some ShapeDeep content is protected and delivered only through backend systems during normal app use.

You must not:

  1. extract protected content from the App or backend;
  2. mass-download lesson payloads;
  3. use scripts, bots, crawlers, automation tools, emulators, modified clients, replay tools, or network interception to collect Content;
  4. bypass authentication, App Check, rate limits, Cloud Functions, Firestore rules, or other access controls;
  5. access backend collections directly where the app is not designed to do so;
  6. reuse protected content outside the App;
  7. publish, sell, sublicense, copy, translate, redistribute, train models on, or create competing products from protected learning content;
  8. attempt to reconstruct protected databases from app traffic;
  9. share extracted Content with third parties;
  10. encourage or assist others to do any of the above.

We may apply rate limits, request validation, caching rules, account checks, App Check, integrity checks, and other security systems to protect Content and service stability.

Exceeding rate limits or triggering abuse protections may temporarily or permanently limit access to affected features.

  1. Virtual Items, XP, JP, CP, Streaks, Rewards, Missions, and Leaderboards

The Services may include app-internal progress and reward systems, including XP, JP, CP, streaks, freezes, reserves, missions, achievements, mystery prizes, leagues, weekly XP, and other Virtual Items.

Virtual Items:

  1. are part of the app experience only;
  2. do not represent money or property;
  3. have no cash value;
  4. cannot be sold, transferred, traded, or exchanged outside the Services;
  5. may be adjusted, reset, removed, or corrected where necessary for security, balancing, bug fixing, abuse prevention, or service integrity.

You must not manipulate or attempt to manipulate Virtual Items, reward systems, leaderboards, missions, streaks, or app economy features.

We may correct inaccurate balances or progress if caused by bugs, abuse, unauthorized access, synchronization errors, test data, or backend corrections.

  1. Learning Content and No Guaranteed Learning Outcome

Shapedeep is a language learning tool. We aim to provide useful, engaging, and motivating learning content.

However, we do not guarantee that:

  1. you will become fluent;
  2. you will achieve a specific exam result;
  3. all translations are perfect in every context;
  4. every explanation fits every dialect, region, or use case;
  5. every exercise is free from mistakes;
  6. every text-to-speech output is flawless;
  7. every language pair has identical content quality or scope;
  8. your progress will be the same as other users’ progress.

Language learning depends on many factors, including effort, consistency, previous knowledge, learning method, memory, context, and individual differences.

The Services are not a substitute for professional translation, certified language instruction, legal, medical, financial, immigration, academic, or professional advice.

  1. Humor, Tone, and Sensitive Content

Shapedeep may use humor, playful examples, edgy wording, fictional scenarios, memes, or exaggerated story situations to make language learning more memorable.

Some content may not match every user’s humor preference.

During onboarding or settings, you may be asked about humor preferences. Where available, these preferences may help shape or route content. However, not every version of the App may provide a fully separate non-edgy content mode.

You must not use the Services to harass, threaten, defame, discriminate against, or target other users.

If you believe content is inappropriate, offensive, wrong, or harmful, you may contact us through the app or by email.

  1. Social Features and Public Profiles

The Services may include social features such as public profiles, profile search, following, followers, friend relations, profile viewing, and related features.

If you use social features, other users may see limited public profile information, such as your display name, username, selected avatar, public profile details, and follow/follower information depending on the feature.

You must not:

  1. impersonate another person or organization;
  2. use misleading names or profile information;
  3. harass, threaten, abuse, shame, or bully other users;
  4. collect other users’ data outside normal app use;
  5. use social features for spam, scams, promotions, scraping, or mass messaging;
  6. attempt to access private user documents or non-public data;
  7. create multiple accounts to manipulate social systems or leaderboards.

We may remove or restrict public profile content, usernames, profile pictures, follow relations, or social activity if necessary to protect users, comply with law, enforce these Terms, or maintain service integrity.

  1. Contact Discovery

The current version of the App may not include device contact access.

If contact discovery is made available in a future or specific version, it will be optional and may require your device permission. If you grant permission, the App may use limited contact information, such as email addresses, to help you find people who already use Shapedeep.

If enabled, contact discovery must not be used for spam, harassment, scraping, or unauthorized invitations.

We do not write, modify, or delete your device contacts.

The details of any contact discovery processing are governed by the Privacy Policy and the app version in which the feature is available.

  1. User Content and Feedback

You may provide User Content, including:

  1. profile names;
  2. selected avatars;
  3. feedback;
  4. bug reports;
  5. feature requests;
  6. support messages;
  7. social actions;
  8. public profile information;
  9. other content or choices you submit through the Services.

You retain rights you have in your User Content.

You grant Shapedeep a worldwide, non-exclusive, royalty-free license to use, host, store, reproduce, display, process, adapt, transmit, and otherwise use your User Content solely as necessary to:

  1. provide the Services;
  2. operate accounts and profiles;
  3. process feedback and support requests;
  4. provide social features;
  5. improve and secure the Services;
  6. comply with law;
  7. enforce these Terms.

For feedback, ideas, suggestions, bug reports, and feature requests, you agree that we may use them without restriction or compensation, provided that our use of personal data remains subject to the Privacy Policy.

You are responsible for ensuring that your User Content is lawful and does not violate third-party rights.

  1. Acceptable Use

You agree not to:

  1. use the Services for unlawful purposes;
  2. violate intellectual property rights;
  3. copy, scrape, redistribute, resell, or exploit Content;
  4. reverse engineer, decompile, disassemble, or attempt to derive source code, except to the extent mandatory law permits this;
  5. bypass technical restrictions, security controls, rate limits, or protected content systems;
  6. interfere with or disrupt servers, networks, Cloud Functions, Firestore, authentication, or app infrastructure;
  7. introduce malware, spyware, bots, scripts, harmful code, or automated attack tools;
  8. use the Services to build or train a competing product using extracted Content;
  9. create accounts using false, misleading, or unauthorized information;
  10. buy, sell, rent, share, or transfer accounts;
  11. manipulate learning progress, rewards, purchases, streaks, achievements, or leaderboards;
  12. exploit bugs instead of reporting them;
  13. use the Services to harass or harm others;
  14. attempt unauthorized access to accounts, APIs, databases, storage, backend functions, or administrative systems;
  15. use the Services in violation of app store policies or platform rules.
  1. Updates and Changes to the Services

We may update the App and Services to:

  1. add features;
  2. improve content;
  3. fix bugs;
  4. improve security;
  5. comply with app store or legal requirements;
  6. change technical infrastructure;
  7. improve performance;
  8. remove outdated features;
  9. protect Content;
  10. adjust balancing, rewards, or learning paths.

Some updates may be required to continue using the Services.

Older app versions may stop working if they are incompatible with backend systems, security requirements, app store rules, or protected content delivery.

We may also release different versions for development, staging, internal testing, production, or other release channels.

  1. Service Availability

We aim to provide reliable Services, but we do not guarantee uninterrupted, error-free, or always-available access.

The Services may be unavailable or limited due to:

  1. maintenance;
  2. updates;
  3. bugs;
  4. third-party provider outages;
  5. cloud service issues;
  6. network problems;
  7. device compatibility issues;
  8. app store issues;
  9. security incidents;
  10. rate limits;
  11. legal or platform requirements;
  12. force majeure events.

We may suspend or limit features where necessary for security, abuse prevention, maintenance, legal compliance, or service stability.

For Free Services, we may modify, restrict, or discontinue features with reasonable notice where appropriate.

For Paid Services, any material changes will be handled according to applicable law, app store rules, and the specific purchase terms.

  1. Third-Party Services

The Services may depend on or interact with third-party services, such as:

  1. Firebase;
  2. Google Cloud;
  3. Google Sign-In;
  4. app stores;
  5. payment providers;
  6. analytics and diagnostics tools;
  7. crash reporting tools;
  8. text-to-speech or device services;
  9. email delivery providers;
  10. browser or link-opening services.

Third-party services may have their own terms and privacy policies.

We are not responsible for third-party services that we do not control. However, where we select processors or service providers to operate the Services, our Privacy Policy explains how personal data is handled.

  1. Analytics, Diagnostics, and Privacy

Our processing of personal data is governed by our Privacy Policy.

The App may include optional analytics and diagnostics. Where required, these features are enabled only after your consent and according to app configuration.

You may be able to change telemetry preferences in the App.

Security, authentication, rate limiting, fraud prevention, and service operation may still require certain technical processing even when optional telemetry is disabled.

By using the Services, you acknowledge that you have read the Privacy Policy.

  1. Advertising and Marketing

Current and future versions of Shapedeep may differ.

A specific released version may not display ads or use advertising identifiers. Future versions may introduce advertising, ad-supported features, sponsorships, rewarded ads, non-personalized ads, personalized ads where permitted, or paid ad-free alternatives.

If advertising is introduced, we will follow applicable law, app store requirements, consent requirements, and Privacy Policy disclosures.

Marketing emails or promotional messages will be sent only where legally permitted. You may unsubscribe from marketing communications. You may still receive service-related communications such as account notices, security messages, legal updates, purchase confirmations, or password reset emails.

  1. Payments, Taxes, and Billing

Where Paid Services are offered, prices may include or exclude taxes depending on the purchase flow, platform, country, and applicable law.

You are responsible for providing accurate billing information where required.

If a payment is reversed, refunded, charged back, declined, or found fraudulent, we may suspend or remove access to the relevant Paid Service.

We may change prices for future purchases or future billing periods. Existing subscriptions will be handled according to applicable law, app store rules, and the notice shown in the purchase flow.

We do not intend to store full payment card details on our own servers. Payment information is typically handled by app stores or payment processors.

  1. Consumer Rights and Statutory Warranty

Nothing in these Terms limits statutory consumer rights that cannot be limited by contract.

If you are a consumer, you may have statutory rights regarding digital content, digital services, defective performance, withdrawal, refunds, and other consumer protections under applicable law.

For Paid Services, we are responsible for providing the digital service in accordance with applicable statutory requirements.

If a Paid Service is defective, your statutory rights remain available.

Any additional voluntary statements, promotional descriptions, or support promises do not replace mandatory statutory rights.

  1. No Professional Advice

The Services are provided for educational and entertainment purposes related to language learning.

The Services do not provide:

  1. legal advice;
  2. tax advice;
  3. financial advice;
  4. medical advice;
  5. psychological advice;
  6. immigration advice;
  7. professional translation certification;
  8. official exam certification.

You should not rely on the Services as the sole basis for important decisions requiring professional advice.

  1. Limitation of Liability

We are liable without limitation for:

  1. intent;
  2. gross negligence;
  3. injury to life, body, or health;
  4. liability under mandatory product liability law;
  5. guarantees expressly given by us;
  6. other liability that cannot be excluded or limited under applicable law.

In cases of ordinary negligence, we are liable only for breach of essential contractual obligations. Essential contractual obligations are obligations whose fulfilment is necessary for proper performance of the contract and on whose compliance you may regularly rely.

In such cases, liability is limited to the typical, foreseeable damage, unless unlimited liability applies under the previous paragraph.

We are not liable for damage caused by:

  1. your misuse of the Services;
  2. unauthorized account sharing;
  3. use of outdated app versions where an update was reasonably required;
  4. device, network, app store, or third-party provider issues outside our control;
  5. unauthorized modifications to the App;
  6. attempts to bypass security systems;
  7. loss of progress caused by using unsupported, modified, or tampered versions of the App;
  8. events beyond our reasonable control.

This limitation applies also to our legal representatives, employees, agents, and service providers.

  1. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Shapedeep from claims, losses, damages, liabilities, costs, and expenses arising from:

  1. your unlawful use of the Services;
  2. your violation of these Terms;
  3. your infringement of third-party rights;
  4. your misuse of Content;
  5. your unauthorized extraction or redistribution of Content;
  6. your manipulation of app systems, rewards, or backend requests;
  7. your User Content.

This clause does not apply where such indemnification is prohibited by mandatory consumer law.

  1. Account Security and Integrity

You must take reasonable steps to protect your Account.

You must not:

  1. share your password;
  2. allow others to use your Account;
  3. use another user’s Account;
  4. create accounts for automated abuse;
  5. attempt to bypass login, verification, or recent-authentication requirements;
  6. use unauthorized tools to access backend systems.

We may require additional verification before sensitive actions.

We may reset sessions, revoke tokens, require password resets, or suspend access if we detect suspicious activity.

  1. Export Control and Sanctions

You may not use, export, re-export, or transfer the Services in violation of applicable export control, sanctions, or trade laws.

You represent that you are not located in a country or region subject to sanctions that prohibit your use of the Services and that you are not listed on a restricted party list where such listing would prohibit access.

  1. Beta, Staging, Internal Testing, and Experimental Features

Some versions of the Services may be made available as beta, staging, internal testing, early access, or experimental releases.

Such versions may:

  1. contain bugs;
  2. have incomplete features;
  3. change without notice;
  4. include test content;
  5. have limited availability;
  6. be subject to additional restrictions;
  7. be revoked at any time.

You must not publicly disclose non-public test content, protected content, screenshots, internal behavior, unreleased features, or security-related findings from private test versions unless we permit it.

Feedback from test versions may be used to improve the Services.

  1. Support and Error Reports

Support is available through the contact methods we provide, such as support@shapedeep.com or in-app support tools.

We may ask for limited information needed to identify your Account, understand a problem, or troubleshoot the issue.

When submitting reports, do not include passwords, payment details, private keys, unnecessary personal information, or sensitive information.

We may not be able to respond to every request immediately, but we aim to handle support requests reasonably.

  1. Changes to These Terms

We may update these Terms from time to time.

We may update the Terms to reflect:

  1. new features;
  2. paid services;
  3. advertising features;
  4. legal changes;
  5. app store requirements;
  6. security improvements;
  7. changes in business operations;
  8. changes to backend systems;
  9. consumer protection requirements.

If changes are material, we will provide reasonable notice where required, for example through the App, website, email, or account notice.

If a change materially affects a Paid Service, your statutory rights and app store rights remain unaffected.

If you do not agree to updated Terms, you must stop using the Services and may delete your Account.

Continued use of the Services after updated Terms become effective means that you accept the updated Terms, unless mandatory law requires a different form of acceptance.

  1. Assignment

You may not transfer or assign your rights or obligations under these Terms without our prior written consent.

We may transfer or assign our rights and obligations where reasonable, for example in connection with a merger, acquisition, restructuring, sale of assets, change of legal form, or transfer of business operations, provided that your mandatory consumer rights are not reduced.

  1. Severability

If any provision of these Terms is invalid, unlawful, or unenforceable, the remaining provisions remain effective.

The invalid provision will be replaced by the applicable statutory rule. Where legally permitted, the parties will interpret the Terms in a way that most closely reflects the economic and legal purpose of the invalid provision.

  1. No Waiver

If we do not enforce a provision of these Terms immediately, this does not mean that we waive the right to enforce it later.

A waiver is effective only if made in writing.

  1. Governing Law

These Terms are governed by the laws of the Federal Republic of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).

If you are a consumer and mandatory consumer protection laws of your country of residence provide greater protection, those mandatory laws remain unaffected.

  1. Dispute Resolution and Consumer Arbitration

We aim to resolve disputes directly and fairly. Please contact us first at support@shapedeep.com.

We are not willing and not obligated to participate in dispute resolution proceedings before a consumer arbitration board, unless mandatory law requires otherwise.

The former EU Online Dispute Resolution platform has been discontinued. Therefore, these Terms do not include an EU ODR platform link.

Your statutory rights to bring claims before competent courts remain unaffected.

For consumers, the legally competent courts apply.

For business users, where legally permitted, the courts of Berlin, Germany, shall have jurisdiction.

  1. Language

These Terms are written in English.

Translations may be provided for convenience. If there is a conflict between the English version and a translation, the English version controls, unless mandatory law requires otherwise.

  1. Entire Agreement

These Terms, together with the Privacy Policy and any purchase-specific terms shown during checkout, form the agreement between you and Shapedeep regarding the Services.

Any feature-specific or purchase-specific terms apply in addition to these Terms. In case of conflict, the more specific terms apply to the relevant feature or purchase.
